These Terms of Service (“Terms”) govern your access to and use of DMtoLead (“we”, “us”, or “our”) websites, products, and services (collectively, the “Services”). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Eligibility & Accounts
You must be at least 16 years old and legally able to form a binding contract to use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@dmtolead.com if you suspect unauthorized access.
Acceptable Use
You agree not to misuse the Services. Prohibited activities include but are not limited to:
Accessing data without authorization, reverse engineering, or attempting to extract source code.
Interfering with or disrupting the integrity or performance of the Services or related infrastructure.
Using the Services to send spam, conduct phishing attacks, or distribute malware.
Violating third-party terms of service (e.g., Meta, Google, Telegram, Stripe).
Using the Services for any unlawful purpose or in violation of applicable regulations.
Reselling or sublicensing the Services without prior written consent.
We reserve the right to suspend or terminate accounts that violate these policies without prior notice.
Subscriptions & Billing
The Services are offered on a subscription basis. Your plan, billing cycle, and pricing are presented at checkout and in your account dashboard.
Free trial: All paid plans include a 3-day free trial. No credit card required to start. At the end of the trial, you will be asked to provide payment to continue.
Billing: Subscriptions are billed in advance on a monthly or annual basis. Payments are processed by Stripe.
Overage: Message overages beyond your plan's monthly limit are billed at the per-1k rate specified in your plan.
Refunds: We do not offer refunds for partial billing periods. You may cancel at any time and retain access through the end of the paid period.
Price changes: We may change pricing with at least 30 days notice. Changes apply to subsequent billing periods.
Third-Party Integrations
You may connect third-party services (Instagram, Facebook, WhatsApp, Telegram, Shopify, Google, Zendesk, etc.). Your use of those services is governed by their own terms and policies. We are not responsible for the availability, accuracy, or conduct of third-party platforms.
Google integrations: When you connect your Google account, you grant DMtoLead permission to access Google Calendar data within the scope you approve (currently the calendar.events scope). We use this access only to create and edit events you request and to derive availability from your calendar. We do not use Google data for advertising or sell it. DMtoLead's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
You can disconnect Google at any time from within the app or via myaccount.google.com/permissions.
AI-Generated Content
The Services generate AI-powered responses based on your configuration and connected data sources. You are solely responsible for reviewing, monitoring, and taking accountability for all AI-generated content sent through your connected channels.
We do not guarantee the accuracy, appropriateness, or completeness of AI-generated responses. You should implement appropriate human oversight for customer-facing communications, especially in regulated industries.
Privacy & Data
Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.
Intellectual Property
DMtoLead retains all rights, title, and interest in and to the Services, including all software, designs, trademarks, and technology. These Terms do not grant you any ownership rights in the Services.
You retain ownership of your content (messages, knowledge base data, configurations). You grant DMtoLead a limited, non-exclusive license to host, process, and use your content solely to provide the Services to you.
Uptime & Service Levels
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party platform outages, and force majeure events may affect availability. We will communicate planned downtime in advance where possible.
Termination
You may stop using the Services and cancel your subscription at any time from your account settings. No refund is provided for the remaining portion of a paid period.
We may suspend or terminate your access immediately and without notice if you violate these Terms, if required by law, or to protect the integrity of the Services. Upon termination, your right to use the Services ceases and we may delete your data in accordance with our Privacy Policy.
Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be error-free, uninterrupted, or free of harmful components.
Limitation of Liability
To the maximum extent permitted by applicable law, DMtoLead and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunities.
Our total cumulative liability for any claims arising out of or related to the Services shall not exceed the amount you paid to DMtoLead in the 12 months preceding the claim.
Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved through good-faith negotiation first; if unresolved, through binding arbitration or competent courts in the jurisdiction where DMtoLead is established.
Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated by email or prominent in-app notice at least 14 days before taking effect. Your continued use of the Services after the effective date constitutes your acceptance of the revised Terms.
